Recent court decisions and lawsuits in Germany demonstrate a consistent trend: the digital environment is under control.
The usual legal mechanisms - administrative and civil - apply to it.
Amazon (Prime)
Customers who subscribed before the 2022 price increase can join the class action lawsuit and demand the return of illegally collected amounts. Registration is taking place through the Federal Office of Justice's registry of claims.
The tool is collective protection of consumer rights.
Eventim
A class action lawsuit against a ticketing service has concluded with a settlement. More than 5,000 consumers have secured compensation after receiving incomplete refunds for canceled events.
The instrument is pressure through joint procedural representation.
What do these cases have in common?
Social media and online platforms are a fully-fledged evidentiary environment, class action lawsuits are becoming a viable defense mechanism, and the state and courts are increasingly responding to digital violations. "It was online" is no longer an excuse.
Germany is gradually building a model for legal oversight of the digital economy – through courts, administrative bodies, and collective defense instruments.
